Terms of Use

The agreement between you and the operator of Moulinery. By using the service, you accept these terms.

Your materials stay yours. We receive only the rights without which the service could not show them back to you.

Rights in the source images are your responsibility — and you indemnify us if a claim is brought against us because of them.

The service is provided "as is", without warranties. Estimates are approximate and liability is limited.

1. Parties and acceptance

1.1. The Moulinery service (the "Service") is available at moulinery.com. The Service is operated by a natural person, the author of the Service (the "Operator", "we").

1.2. A user ("you") is any person who opens the Service or creates an account in it.

1.3. By starting to use the Service, you confirm that you have read these Terms, agree to them and undertake to comply with them. If you do not agree, do not use the Service.

1.4. These Terms apply together with the Privacy Policy, which forms an integral part of them.

2. What the Service is

2.1. The Service turns an image you load into a cross stitch chart: it matches Gamma or DMC floss numbers, estimates thread use and prepares a version for printing.

2.2. The chart is computed in your browser, on your device. The image is not transmitted to the Operator.

2.3. The Service is under development. It has gained, and may gain, the following: accounts, synchronisation of saved projects across devices, publication of finished work in a shared gallery, and paid features. These Terms apply to all such features from the moment they appear.

2.4. The Operator may at any time change what the Service does and how, add and remove features, or discontinue it entirely, subject to clause 14.

3. Who may use the Service

3.1. The Service may be used by persons aged 13 and over.

3.2. If you are located in the European Economic Area and are under 16, creating an account requires the consent of your parent or other legal guardian.

3.3. By creating an account you confirm that you have the legal capacity required to accept these Terms.

4. Accounts

4.1. Some features of the Service — above all synchronising projects across devices — require an account. Signing in is handled by third-party authentication services, in particular a Google account.

4.2. The data the Service receives when you sign in, and the purposes of processing it, are described in the Privacy Policy.

4.3. You are responsible for keeping secure the account you use to sign in, and for all actions taken through it.

4.4. You may delete your account in the Service at any time. The deletion procedure and the fate of associated data are described in the Privacy Policy.

4.5. The Operator may suspend or terminate access to an account in the event of a breach of these Terms, where the operability or security of the Service is threatened, or where required by law.

5. Your materials and rights in them

5.1. "Materials" means the images you load into the Service, together with the charts, settings and other results obtained with its help.

5.2. Exclusive rights in the Materials remain yours. The Operator acquires no rights in them other than those expressly listed below.

5.3. If you use synchronisation, you grant the Operator a non-exclusive, royalty-free licence to store, reproduce and transmit the projects you saved — solely to the extent necessary to show them to you on your devices. The licence lasts while the project is stored in the Service and ends when it is deleted.

5.4. If you choose to publish finished work in the shared gallery, you grant the Operator a non-exclusive, royalty-free licence to display it within the Service and in materials about the Service. That licence ends when the publication is deleted; the Operator is not obliged to recall copies already distributed by third parties.

5.5. The Operator does not use your Materials to train machine learning models and does not share them with third parties, other than infrastructure providers acting on the Operator's instructions.

6. Rights in source images

6.1. The Service does not check, and technically cannot check, whether you hold rights in the images you load.

6.2. By loading an image, you represent and warrant that you hold the necessary rights or that using the image is permitted by law.

6.3. Creating a chart from someone else's image does not transfer any rights in that image to you. Producing and selling charts or finished work based on protected works without the rightsholder's permission is prohibited.

6.4. You bear responsibility for any infringement of third-party rights arising from your use of the Service.

7. Acceptable use

7.1. When using the Service you must not:

7.2. The Operator may restrict access in the event of a breach of this section, including without prior notice where the breach threatens the operability or security of the Service or the rights of third parties.

8. The Operator's rights

8.1. Exclusive rights in the Service, its source code, its design, the "Moulinery" name and the colour matching tables compiled by the Operator belong to the Operator and are protected by law.

8.2. These Terms grant you no right to use the "Moulinery" name or the Operator's other identifiers.

8.3. The names Gamma, DMC and other floss manufacturers' names belong to their respective rightsholders and are used solely to indicate colour correspondence.

9. Third-party services

9.1. To sign in to an account, the Service uses Google's third-party authentication service. By using it, you additionally accept Google's terms and privacy policy.

9.2. The Service is hosted on a third-party provider's infrastructure. The Operator does not control third-party services and is not responsible for their availability or their actions.

10. Price

10.1. As at the date of this version, the Service is provided free of charge.

10.2. The Operator may introduce paid features. Payment terms will be published before they are introduced, and using paid features will be voluntary.

10.3. Introducing paid features does not result in any automatic charge and does not require you to pay for features you already use free of charge, unless you separately agree to it.

11. Accuracy of estimates

11.1. All figures produced by the Service are estimates and are not a guarantee of the result.

11.2. The Operator is not responsible for materials you buy that do not meet your expectations, for shortfalls in materials, or for costs incurred in reliance on the Service's estimates.

12. No warranties

12.1. The Service is provided on an "as is" and "as available" basis.

12.2. The Operator does not warrant that the Service will run without interruption or error, that it is fit for your particular purposes, that data stored in your browser will be preserved, or that it is compatible with every device and browser.

12.3. You are responsible for backing up work that matters to you. The Service provides the ability to save a project to a file for this purpose.

13. Limitation of liability

13.1. To the maximum extent permitted by applicable law, the Operator is not liable for lost profit, loss of data, reputational harm or other indirect losses arising in connection with the use of, or inability to use, the Service.

13.2. The Operator's aggregate liability for all claims connected with the Service is limited to the amount actually paid by you to the Operator in the twelve months preceding the claim or, where no such payments were made, to an amount equivalent to €50 (fifty euros).

13.3. The limitations in this section do not apply to liability that cannot be limited under applicable law, including for intent and gross negligence, and for harm to life and health.

13.4. Where applicable law does not allow the exclusion of particular warranties or the limitation of liability, the relevant provisions apply to the maximum extent that law permits.

14. Changes and termination

14.1. The Operator may amend these Terms. A new version is published on this page with its date.

14.2. The Operator gives advance notice of material changes in the Service's interface and, if you have an account, also to the email address associated with it.

14.3. Continuing to use the Service after changes take effect constitutes acceptance of the new version. If you do not agree, stop using the Service and delete your account.

14.4. You may stop using the Service at any time.

14.5. If the Service is discontinued, the Operator will give account holders advance notice and the opportunity to export their saved projects.

15. Indemnity

15.1. You undertake to indemnify the Operator against documented losses, including reasonable legal costs, arising from third-party claims connected with Materials you loaded, with your breach of these Terms, or with your breach of applicable law.

16. Governing law and disputes

16.1. The parties will seek to resolve disagreements by negotiation. A claim should be sent to the address given in section 17; we reply within 30 calendar days.

16.2. If a dispute cannot be settled by negotiation, it is to be heard at the Operator's location, unless mandatory rules of the law of your country of habitual residence provide otherwise.

16.3. If you are a consumer resident in the European Economic Area, these Terms do not deprive you of the protection afforded by mandatory rules of the law of your country of residence.
